Terms of Service

Last updated October 29, 2026

These terms are the agreement between you and Balanced Company (“we”, “us”), the operator of Flowformance. By using Flowformance, you agree to them. Please read them carefully.

1. Agreement to these terms

By creating an account, accessing or using Flowformance (the “service”), you agree to these Terms of Service and to our Privacy Policy. If you are using the service on behalf of an organization, you represent that you are authorized to accept these terms for that organization. If you do not agree, do not use the service.

2. Who may use the service

You must be at least 18 years old and able to form a binding contract to use Flowformance. The service is a business tool and is not intended for personal or household use.

3. Accounts and workspaces

You are responsible for the activity in your account and workspace, for keeping your sign-in secure, and for your team members’ use of the service. Content in a workspace is accessible to that workspace’s members according to the roles and visibility settings you configure.

4. Plans, billing, trials and refunds

  • Paid plans are billed in advance on a recurring basis through Stripe until canceled. By subscribing, you authorize us to charge your payment method for each billing period.
  • Free trials, where offered, convert to a paid plan at the end of the trial unless you cancel beforehand.
  • You can cancel at any time; cancellation takes effect at the end of the current billing period, and you keep access until then.
  • After your subscription ends, we keep your workspace and its content for 60 days so you can reactivate without losing anything. If you do not reactivate within that window, your workspace and all of its content are permanently deleted and cannot be recovered. Residual copies in our operational backups expire within 30 days after that.
  • You may instead choose to have your data deleted when you cancel, by selecting that option in the cancellation flow. If you do, we permanently delete your workspace and its content after a short processing period (currently about 7 days) rather than keeping it for 60 days; residual backup copies expire within 30 days after that. This is irreversible, so export anything you want to keep first.
  • Except where required by law, payments are non-refundable and we do not provide refunds or credits for partial periods or unused features, except referral credits under the Referral Program terms. Prices may change with notice for future billing periods.
  • If a payment fails or an account becomes past due, we may limit the workspace to read-only access until the balance is resolved.

5. Fair use, overuse, and our right to throttle, pause or cancel

Our plans are intended for normal business use. We reserve the right to throttle, pause, suspend or cancel any account or workspace whose usage constitutes overuse, with or without notice, and to require an upgrade to a higher plan.

“Overuse” means usage that materially exceeds what is typical for your plan or that places a disproportionate burden on the service, including for example:

  • capture, transcription, storage or AI usage that substantially exceeds the limits or the typical volume described for your plan at sign-up;
  • API requests that exceed our published rate limits, or automated, scripted or bulk activity that degrades performance for others;
  • storage or bandwidth consumption far above that of comparable customers on the same plan;
  • using one account or workspace to serve multiple unrelated organizations, or otherwise structuring usage to avoid plan limits;
  • any use that threatens the stability, security or integrity of the service.

Where practical, we will first apply softer measures — such as lowering the priority of heavy jobs or reaching out to discuss an appropriate plan — before pausing or canceling. Repeated or severe overuse, or overuse that harms the service or other customers, may result in immediate suspension or termination.

6. AI features

Flowformance uses AI to transcribe recordings and to draft, edit and answer questions about your content. AI output can be inaccurate, incomplete or misleading, and may not reflect your latest processes. You are responsible for reviewing and verifying AI-generated content before you publish or rely on it. AI output is not legal, financial, medical or other professional advice. We do not warrant the accuracy of any AI-generated content. Details of how content is processed by AI providers are in our Privacy Policy.

7. Email capture — your responsibilities

If you enable email capture on your public portal or videos, you are the controller of the leads you collect and you are solely responsible for that data. You agree that you:

  • have a lawful basis and any required consent to collect and contact those individuals;
  • will comply with all applicable privacy, data-protection and anti-spam laws (including, in the United States, the CAN-SPAM Act);
  • will honor unsubscribe and deletion requests and maintain your own privacy notice to your visitors;
  • will not collect sensitive personal information or use captured emails for unlawful, deceptive or harmful purposes.

You will indemnify us for claims arising from your use of email capture, as described in the indemnification section below.

8. Acceptable use

You agree not to:

  • use the service to store or share unlawful, infringing, harmful or deceptive content, or content you do not have the right to use;
  • probe, scan, overload, disrupt or attempt to gain unauthorized access to the service or other users’ data;
  • resell, sublicense or provide the service to third parties except as expressly permitted by your plan;
  • reverse engineer the service, or use it to build a competing product; or
  • use the service in violation of any applicable law or these terms.

9. Your content

You own the content you create in Flowformance. You grant us a limited, non-exclusive license to host, process, transmit and display your content, and to share it with the service providers described in our Privacy Policy, solely to operate and improve the service for you. You are responsible for having the rights to the content you submit, including any recordings of people or systems.

10. Our intellectual property

The service itself — including Flowformance’s software, design, and trademarks — belongs to us and our licensors. These terms do not grant you any rights in our intellectual property except the limited right to use the service. Your documents remain yours; markdown is the source of truth and your workspace admins can export it at any time.

11. Third-party services

The service relies on third parties, including Cloudflare (hosting, storage, delivery, video, AI transcription and AI request routing, email and bot protection), Anthropic (AI), Stripe (payments) and Google (web fonts, and website analytics and advertising where enabled), and we may add or change providers over time. Your use of those features may also be subject to the providers’ own terms. We are not responsible for third-party services outside our control.

12. Your data and backups

You are responsible for maintaining your own backups of your content. The service provides export tools (including markdown and archive exports), and you should keep your own current copies of anything important. While we take routine operational backups for our own resilience, we do not guarantee them for your recovery and you should not rely on them as your backup. To the fullest extent permitted by law, we are not liable for any loss, corruption or deletion of content.

13. Bot protection (Cloudflare Turnstile)

We use Cloudflare Turnstile to protect our sign-in and public forms from abuse and automated bots. Turnstile runs in a hidden (invisible) mode, so you will usually not see a challenge. Because the widget is not displayed, we disclose its use here: this site is protected by Cloudflare Turnstile, and the Cloudflare Privacy Policy and Terms of Service apply. Turnstile may collect device and browser signals to assess whether a request is coming from a human; it is designed to avoid tracking users across sites.

14. Disclaimers

The service is provided “as is” and “as available,” without warranties of any kind, whether express, implied or statutory, including any implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the service will be uninterrupted, error-free or secure, or that any content — including AI-generated content — will be accurate or reliable.

15. Limitation of liability

To the fullest extent permitted by law, Balanced Company and its owners, employees and suppliers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising out of or related to your use of the service. Our total liability for any claim relating to the service will not exceed the greater of the amounts you paid us for the service in the twelve months before the claim, or US$100.

16. Indemnification

You agree to indemnify and hold harmless Balanced Company and its owners, employees and suppliers from any claims, damages, liabilities and expenses (including reasonable legal fees) arising out of your content, your use of the service, your use of email capture, or your violation of these terms or of any law or third-party right.

17. Suspension and termination

You may stop using the service and cancel at any time. We may suspend or terminate your access if you violate these terms, if your account is past due, in cases of overuse as described above, or as needed to protect the service or comply with law. On termination, your right to use the service ends; export your content beforehand, as content may be deleted after termination.

18. Changes to the service and these terms

We may change, add or remove features of the service, and we may update these terms from time to time. When we make material changes to these terms, we will update the “Last updated” date and provide notice where required. Your continued use of the service after changes take effect means you accept the updated terms.

19. Governing law and venue

These terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-laws rules. You agree that the exclusive venue for any dispute that is not subject to another agreed process will be the state or federal courts located in Texas, and you consent to their jurisdiction.

20. Miscellaneous

These terms and our Privacy Policy are the entire agreement between you and us regarding the service. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets.
